California Court Says 10 Day Waiting Period Is Likely Unconstitutional

In California when you purchase a new firearm you are required to wait ten days.  This means if you purchase a new rifle on Monday at 10am you must return after 10am on Thursday of the following week.  Big 5 sporting goods takes this 10 waiting period an extra day further and takes on an extra day as a buffer just to be sure. 

The idea behind the ten days is a "cool down" period so that if someone was looking to do something bad (murder, suicide, etc) that heat of the moment would die down during the wait time. California also uses this ten day period for conducting a background check, although we all know it doesn't actually take that long. 

Well, a recent court case is challenging this ten wait period saying it is prohibiting people from exercising their constitutional right to bear arms during the wait time.  Kamala Harris, CA's Attorney General, was denied a motion for summary judgement yesterday, and chances are good this case will go to the Federal Appeals Court. 

This a small step in the right direction, but the fight is far from over.  I'd be willing to put money that the courts will rule the waiting period unconstitutional, but it might take a little time; the wheels of government turn slowly.  If you like to read all the boring court documents and more info, please visit the CalGuns Foundation page.
